1. BOOKING CONFIRMATION: Bookings will only be confirmed once the initial non-refundable fee has been paid.
2. LATE ARRIVAL: If you (the client) are more than 30 minutes late for your session without contacting Dogs In Action Photography, your session will be cancelled and booking fee forfeit. Subsequent bookings will require a further non-refundable fee.
3. TRAVEL: Travel over 30 miles from Ivybridge, Devon is charged at £0.50 per mile. This is payable with the final payment.
4. FEE CONTENT: Session fee is for up to two dogs from the same household. If more than two dogs are present and are clearly not from the same household, the photographer has the right to cancel the session with loss of the initial non-refundable fee. The fee includes 10 .jpg photos that will be sent to you electronically. The client will have up to 50 images to choose from. These will be watermarked. Photos will only be released (with watermark removed) to the client once the final payment is paid in full. The client’s gallery will be deleted after 28 days if final payment is not received.
5. ADDITIONAL IMAGES: Additional images can be purchased, and these will be charged at £5.00 per photo and sent electronically. The client’s gallery will remain active for 12 months after the session date, provided final payment has been made (see above).
6. LIABILITY: The client expressly releases the photographer from all claims, damages, and liabilities that may result from accidents or incidents that occur during the session. This waiver of liability includes waiver of any claim that may be a result of negligence.
The performance of this contract on behalf of “Dogs In Action Photography” shall be contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, and/or conditions beyond its control.
7. PHOTOGRAPHER USE OF IMAGES: As part of standard marketing, Dogs In Action Photography may upload a selection of the photos taken in this session to its website, Facebook and Instagram pages. Some of the images may also be used for advertising purposes. If you would prefer images weren’t used in this way, please state this before your session. All Copyright remains the exclusive property of Dogs In Action Photography.
8. CLIENT’S USAGE: The client is obtaining prints / digital files for personal use only, and shall not sell said digital files . Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Dogs In Action Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs. Dogs In Action Photography grants the client full non commercial printing rights of all the purchased digital images supplied.
9. RESHOOTS: In the unlikely event that Client is completely dissatisfied with the final results based solely on personal preference, the photographer will reshoot for free. The client is then able to order images from the second session only. Only one additional session will be offered. In the unlikely event that the finished product from the session is unusable due to technical problems, (camera failure or exposure problems), the photographer will reshoot at no additional charge.
10. LIMIT OF LIABILITY: Dogs In Action Photography takes the utmost care with respect to digital captures. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged.
11. CANCELLATION/POSTPONEMENT (Client): The Client understands that by entering into this agreement, the photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the session/agreement by Client, with less than 48 hours’ notice, the initial fee paid is non-refundable. With more than 48 hours’ notice, the photographer is prepared to re-book once only.
12. CANCELLATION/POSTPONEMENT (Photographer): If the photographer needs to cancel the session due to, for example, bad weather, illness or injury, the photographer will give the client as much notice as possible and will re-book the session at no additional cost at a time convenient to the client.
13. DOG BEHAVIOUR: Throughout the photo session the owner of the dog(s) is responsible for the behaviour and actions of their dog(s), including clearing up after them and Dogs In Action Photography will not be responsible for any injury to the dogs, owner or third party during the photography session.
14. CHILDREN: If the client wishes to involve a minor (under 18), this must be discussed with the photographer prior to the session and parental consent must be given prior to the session. An adult (over 18) must be present for the full session and responsible for the dog.
15. DOG WELFARE. The welfare of the dog(s) in the photo session is paramount. The session may be suspended or cancelled (to be rescheduled) altogether should the dog(s) show signs of unease, discomfort or other adverse physical or emotional condition. Should Dogs In Action Photography become concerned over the welfare of the animal at any point during the sessions the photographer reserves the right to terminate the session immediately.
16. SESSION CONTENT – At the pre-session consultation the client and photographer will discuss the client’s requirements for the session. During the session, the photographer will attempt to meet these requirements. However it must be understood and accepted that the photo shoot will be as the photographer’s professional expertise determines and that some requirements may not be met due to the circumstances of the day, for example dog behaviour. Special requests are not binding instruction, although every effort will be made to comply with the clients wishes. The success of the session depends on the owner and dog cooperating with the photographer. The photographer is not responsible for missed images due to details not revealed to the photographer. Therefore it is essential, the owner provide full disclosure on their dogs preferences and behaviour to the photographer at the pre-session consultation call.
